Terms of Use

These terms govern your use of the Quiet Garden app. By creating an account or using the app, you accept them. We wrote them to be understood.

Last updated:

1. Who provides the service

Quiet Garden is provided by Gonzalo Escudero (“we”), tax ID (CUIL) 20-40388835-5. Contact: contact@quietgarden.app.

2. What Quiet Garden is

Quiet Garden is a daily writing app. You write short reflections, the app offers another way to see them, generated by artificial intelligence, and with that you tend a garden. It also includes short breathing, attention and gentle movement exercises (“Moments”). It is a journal, not a medical device. It gives no medical, psychological or other professional advice, does not diagnose or treat any condition, and does not replace help from a professional.

3. Your account

  • To keep your garden you need an account: with Apple, with Google, or with an email code.
  • You must be at least 13, or the age your country requires to consent on your own.
  • You are responsible for keeping access to your account secure (your email or your Apple or Google account).

4. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, for personal, non-commercial use, under these terms and the usage rules of the store you downloaded it from. The app, its design, illustrations and code belong to us or our licensors; third-party licence notices are in Settings → Licences.

5. Your content is yours

Everything you write in Quiet Garden is yours. We claim no ownership of your reflections.

To provide the service, you give us a limited licence to store, process and display your content, and to send it to the AI provider that generates responses and runs the safety classification. That licence exists only to run the app for you: we don’t use your content to train models, publish it or sell it. It ends when you delete your content or your account. Details are in the privacy policy.

If you share a postcard of your garden, you choose with whom and where. Postcards never include what you wrote.

6. Acceptable use

Please don’t:

  • use the app for anything illegal or to harm others;
  • try to access accounts or data that aren’t yours;
  • interfere with the app or its servers, or try to bypass its limits or the purchase system;
  • use automated means to generate content or extract AI responses in bulk;
  • copy, modify, decompile or redistribute the app, except as the law allows.

7. About the artificial intelligence

The other way to see it, and with Premium the notes and letters, are generated by an AI model. It can be wrong, misunderstand what you meant, or not help. It is not professional, medical or psychological advice. Take it as a suggestion: you can mark whether it helped, or ignore it. Decisions about your life are yours.

8. Moments and gentle exercises

Moments include breathing, attention and gentle movement, such as stretching or tensing and releasing muscles. Do them slowly and never into pain. If you have an injury, a breathing or heart condition, are pregnant, or have any doubt, ask a professional first. If anything hurts or makes you dizzy, stop.

9. If you are going through a hard time

Quiet Garden is not an emergency or crisis service. The app may show you help resources if it detects signs of risk, but that detection is automated and imperfect and may not trigger. If you are in danger or thinking of harming yourself, call your local emergency services or a helpline now (for example, 988 in the United States; in Argentina, 135 (AMBA) or 0800-345-1435).

10. What is free, and Premium

The heart of Quiet Garden is and will stay free: writing, the other way to see it, watering, the garden, the seeds that arrive by writing, your history with search, and exporting and deleting your data.

Premium is optional and adds garden decor, premium seeds, the seasons, all the Moments and, once available, the notes and letters. It comes in three forms:

  • Monthly and yearly: subscriptions that renew automatically at the end of each period, for the same term and at the current price, until you cancel.
  • Lifetime: a one-time payment, to use Premium for as long as the app is offered.
  • Price: shown in your currency in the app and in the store before you buy, with taxes as your country applies them.
  • Free trial: the yearly plan may include 7 days free. We remind you two days before it ends. If you don’t cancel before the trial ends, the subscription starts and the first year is charged.
  • Charging and renewal: Apple (App Store) or Google (Google Play) charges your store account. Renewal is charged within the 24 hours before the period ends.
  • Cancelling: from your Apple or Google account’s subscription settings, at least 24 hours before the period ends. You keep Premium until the paid period ends. Deleting the app or your account does not cancel the subscription with the store.
  • Price changes: if a subscription’s price changes, we tell you in advance, and the store asks for your consent where the law or its rules require it.
  • Refunds: handled by the store under its rules, without prejudice to the right to cancel (section 11).
  • Restore purchases: in Settings or on the Premium screen, to get Premium back on another device with the same store account.
  • What you made stays: if Premium ends, everything you already placed or planted stays in your garden and keeps working. You just can’t add new Premium things.

11. Right to cancel a purchase

If you are a consumer in Argentina, you may revoke your Premium purchase within 10 calendar days of making it, without giving a reason and at no cost (Law 24.240, article 34). See how on the cancel a purchase page. Elsewhere, the rights your law grants you and the store’s refund rules apply. In the European Union and the United Kingdom, the store handles the right of withdrawal under its own terms.

12. Availability

We do our best to keep the app working well, but it is provided “as is” and “as available”. There may be interruptions, errors or changes to features. We may change or discontinue parts of the service; if we discontinue the app, we will give you reasonable notice so you can export your data.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, for loss of data or profits arising from using or being unable to use the app, or for decisions you make based on AI responses. Nothing here limits rights you have under consumer protection law or other rules that cannot be waived.

14. Termination

You can stop using Quiet Garden whenever you like and delete your account from Settings → Delete everything (or as explained in delete your account). We may suspend or close an account used in serious breach of these terms; unless the law or safety prevents it, we will tell you and you will be able to export your data.

15. Changes to these terms

If we change these terms in an important way, we will tell you in the app with reasonable notice before the change takes effect. If you don’t agree, you can export your data and delete your account.

16. If you downloaded the app from Apple’s App Store

  • These terms are an agreement between you and us, not with Apple. We alone are responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation with respect to the app.
  • We, not Apple, are responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, consumer protection or privacy claims, and claims that the app infringes a third party’s intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo, nor listed on any US Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms when using the app (for example, your mobile data provider’s).
  • Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you as such.

If you downloaded the app from Google Play, Google Play’s terms also apply.

17. Governing law and jurisdiction

These terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the competent courts of the Argentine Republic, without prejudice to the rights you have as a consumer under the law of your place of residence, including the right to bring a claim before its courts.
